Terms and Conditions of LIVE In Person Auctions

1. All articles are offered “AS IS & WHERE IS” in units of measure as announced. Bidders shall rely upon their own inspections. Auctioneer(s) reserves the right to group, modify, increase, diminish or delete lots at their sole discretion.
2. Auctioneer(s) will receive bids from any responsible and registered bidder.
3. Auctioneer(s) may refuse to accept any bid which is but a trifling advance over the prior bid, is trifling itself, or which contains conditions not acceptable to the Auctioneer(s) or Seller.
4. Upon the award of bid, title and all risk of loss, damage to or destruction of the purchased item passes to the purchaser. Auctioneer(s) will have no liability whatsoever for any personal injury or accidents that may occur.
5. Bidders will be identified by number rather that by name in order to expedite the auction. Bidders are strictly responsible for any items which are sold to their bidder number.
6. All purchases are to be paid in full on the day of the auction and prior to removal from premises. No items may be removed until settled for in the manner announced. All items must be removed within the time announced at the auction, at the purchaser’s sole cost and risk.
7. When required by law, and applicable, sales tax will be added to the purchase price of all taxable items.
8. All rights, privileges and powers reserved or granted to Auctioneer in the Terms of Auction shall be deemed reserved and granted to Auctioneer’s employees, representatives, and all owners fro whom the items are being sold.
9. Announcements made day of auction may take precedence over these Terms of Auction or other printed material. All Auctioneer(s) are licensed by the Ohio Department of Agriculture, and participate in the Auction Recovery Fund.

Terms and Conditions of ONLINE Auctionology Auctions

Registration: If you are a first time bidder and would like to participate, click on the ‘register’ button. You will be redirected to a Registration Page, where you will submit the required information. You will then be emailed a Bidder Number, which you will use for each auction. This number is to be used over and over again. YOU DO NOT HAVE TO RE-REGISTER FOR A NEW NUMBER EACH TIME. Do not share your bidder information, as you are responsible for ALL bids placed under this Bidder Number. It is important that you update your Bidder Profile, should the information change.
Placing your bids: Once you have signed in under your Bidder Number, the Current Amount is indicated, followed by the next required bid. You may enter that amount or place a higher bid under ‘Your Bid’ window. You will be advised if you are the winning bidder at this time. Bids must be submitted per page. You should immediately review your bids once submitted.
Max Bids: The ‘Max Bid’ feature allows you to set the Maximum price that you are willing to spend on that item. Max Bids are NOT disclosed! If someone places the next required bid, your price will only increase according to their bid. You should immediately review your bids once submitted.
Bidding Errors: If you mistakenly increase your own bid, place your bidder number in the bid field, or make a typo you must immediately contact Country Acres Auction Services, LLC at 740-954-3034 or by email cmorrison@countryacresauctions.com. We will not reverse bids after the auction has CLOSED –NO EXCEPTIONS.
Bid Notification: If you have been out bided, you will be notified by email ONLY, until Midnight EST the night BEFORE the auction ends. If you win any items, you will receive an invoice by email ONLY. You are responsible for checking your email. If you feel you have won an item and have not received an email, please check your SPAM folder first. If you still haven’t received an email, you must notify us by email no later than 9am the next day. Your invoice will detail date, time, and location of pickup.
Review Bids: To quickly review your bids and see if you have won, you can utilize the ‘review bids’ feature. Items that you have been outbid on will be clearly marked with a red arrow.
Terms: 13% Buyer’s Premium with a 3% discount for Cash or Check. Accepted forms of payment are Cash, Check, MasterCard and Visa, American Express and Discover Card. Any Invoice that is greater than $1,000.00 dollars will require payment to be by certified funds, cash or Credit Card. Payment will be collected at the time of pickup. After the auction is over, you will receive an invoice via the registered email. Listings will reflect Sales Tax in the amount of 7.25% to be applied to the Bid Total (total prior to the Buyer’s Premium) at the following location: 141 E. Main St. Suite A  Ashville, Ohio 43103. Please bid accordingly. If you are tax exempt, please be prepared to complete a Vendor’s Tax Exemption Certificate.
Bidders are responsible for their own removal of items purchased: Items cannot be transferred to an alternate location. Therefore, it is necessary to pick up the items on the date and time stated. Any items NOT picked up by the set time will be considered abandoned. No refunds or charge backs will be granted due to lack of removal at designated times. Removal shall be at the expense, liability, and risk of the purchaser. Purchases will be released upon payment. No items will be released without a paid email receipt. Loading assistance MAY BE available if specified, IF NOT please be prepared to bring help and equipment to load your items. For small items, please bring sufficient packing materials and boxes.
In the case of an emergency and you are unable to make it to the pickup, PLEASE CALL the Country Acres Auctions Services, LLC BEFORE the scheduled pickup time to let them know that you are unable to make it. However, you may send someone to pick up your items on your behalf, but you must call Country Acres Auction Services, LLC to let them know in advance. If you cannot make it to an Onsite auction pickup, call the Country Acres Auction Services, LLC to see if arrangements can be made to transport your items back to the warehouse. This excludes ANY large or heavy items and lots with multiple items in them. Items MUST be paid in advance by credit card and additional charges will apply. THIS IS NOT A SERVICE AND TO BE USED FOR EMERGENCIES ONLY! If items are transported, they must be picked up at the Warehouse during the next scheduled pickup time. Due to limited space, after ONE WEEK, they will be considered abandoned and will no longer be available to you. NO EXCEPTIONS.
In the event of a discrepancy of an item, the Buyer must notify Country Acres Auction Services, LLC staff at the pickup. If items are removed from location, the Auctioneer(s) and Buyer agree that no adjustment or refund will be made.
Shipping Requests: If you are an Out of State Winning Bidder, you will be contacted the morning following the close of the auction. If you are within the State of Ohio and would like your items shipped, please contact Country Acres Auction Services, LLC on the Auction Detail page. Payment is to be made by credit card to expedite shipping and allow the close of the sale. The charge will reflect the Bid Total, 13% Buyer’s Premium assessed to the Total, a handling fee and associated taxes (within the State of Ohio only). Shipping is not inclusive of furniture, large or heavy items. Item(s) will be transferred to Quality Box & Pack, a professional shipping company where you will be contacted separately to make arrangements for shipping charges. Item(s) should be shipped within 10 business days after removal and payment date. Country Acres Auction Services, LLC assumes no liability for shipping and is at the risk of the Buyer. Any shipping claims must be made directly with the shipping company. Staggered Closing: The online auction closes in increments as detailed in the closing bid terms (1-3 items per minute). This feature will close the bidding on intervals, which works great with the auto-extend feature to closely emulate the excitement of a ‘live’ auction.
Dynamic Closing: The closing time of an item is automatically extended an additional 5 minutes whenever a bid is placed within the last 5 minutes of the item’s closing time. It will continue to extend 5 minutes until there is no more active bidding.
CAUTION: Varied equipment may be joined for demonstration purposes. Do not assume a lot consists of more than one item simply because they are connected or pictured together. Please inspect the lot numbers and read the descriptions.
Catalog Inaccuracies: You are bidding on the described items NOT the photos. Occasionally the wrong photo is displayed always read the item description.
Warranty & Condition of Items Sold: All items are sold “AS IS, WHERE IS”, with NO WARRANTY expressed or implied by the lot number affixed to the item. Descriptions are believed to be accurate but not guaranteed. Please bid accordingly when you are not certain of the condition or use of an item. Should you have any questions regarding items in a particular auction, please contact Country Acres Auction Services, LLC. IMPORTANT ! The Auctioneer(s) will have the option of reselling, removing, storing or abandoning, at the expense and risk of the purchase, items not paid for and/or removed within the specific time. The buyer agrees to pay all deficiencies, legal, collection; transportation and storage expenses associated with delinquent accounts or abandoned items.
Choose Wisely: We want everyone to get a good deal and most everyone will. However, when you bid on the wrong item or decide an item is not suited for your intended use, our clients and or staff are not willing to assume the cost of your mistakes. When in doubt about condition, completeness or suitability for intended use, please bid accordingly.
The Auctioneer(s) reserves the right to add or remove items from the auction – split or combine lots – add minimum bids or reserve prices – cancel, suspend, extend or reschedule an individual item and or auction event – make changes to the auction closing times or inspection or removal times.
Any controversy or claim arising out of or relating to this contract and/or agreement, or breach thereof, shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, and judgments upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Court appearance will be Pickaway County Ohio.
Liability: Auctioneers and Sellers liability shall be limited to the refund of bidders purchase price.
Limitations: The above-stated Conditions of Sale cannot be altered except in writing by The Auctioneer(s).
